Terms of Service
Account Details
It is your responsibility to ensure your account information (including all contact information) on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account.
Account Setup
We try our best to respond to account requests promptly, and once your request has been forseen to and account details sent, you have 7 days to upload some sort of index page to replace our standard new account page. If our default page still exists on your new account after 7 days then we reserve the right to suspened the account. You will be notified, and you'll have 48 hours to resolve the issue, during this time the suspension will be lifted. If after this 48 hour period, no website has been uploaded, then we may terminate your account.
Backups & Data Loss
Use of the service is at your sole risk. Creative Hoster is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Creative Hoster servers. Daily,Weekly and Monthly backups will be performed but is not guaranteed.
Termination
Creative Hoster reserves the right to terminate any account, at any time, wether it be for breaking the TOS or AUP or as per request from the account owner. If we do terminate your account, we will do our best to contact you regarding this matter.
Resource Usage
Users may not initiate the following:
1) Run any process that Creative Hoster deems excessive.
2) Run any type of interactive real-time chat applications that require server resources without permission from an administrator.
3) Run stand-alone, unattended server-side processes at any point in time on the server.
4) Run any software that interfaces with an IRC (Internet Relay Chat) network without permission from an administrator.
5) Run any bit torrent application, tracker, or client.
6) Participate in any file-sharing/peer-to-peer activities.
Bandwidth And Space
You agree to not exceed the allotted monthly bandwidth or total disk space. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next monthly cycle. Unused transfer in one month cannot becarried over to the next month.
Disclaimer
Creative Hoster will not be responsible for any damages you or your business may suffer. Creative Hoster makes no warranties of any kind, expressed or implied for services we provide. Creative Hoster disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Creative Hoster and its employees.
Changes to TOS & AUP
Creative Hoster reserves the right to alter the Terms of Service and Acceptable Use Policy at anytime without prior notice. If at any time the TOS and/or AUP are altered in anyway, Creative Hoster will make an attempt to inform all users of any changes made by either website, forum, and/or e-mail. Continuation of service after the revised TOS and/or AUP has been available will constitute and agreement to follow the updated TOS and/or AUP. If at any time the TOS and/or AUP is altered and you feel you are unable to agree to it's terms please contact sales/billing immediately.
Acceptable Use Policy
Failure To Adhere to our AUP will result in account termination, banning and contacting the neccessary legal authorities.
This Acceptable Use Policy document, including the following list of Prohibited Activities, is an integral part of your Hosting Agreement with Creative Hoster. If you engage in any of the activities prohibited by this AUP document Creative Hoster may suspend or terminate your account.
Creative Hoster's Acceptable Use Policy (the "Policy") for Creative Hoster Services is designed to help protect Creative Hoster, Creative Hoster's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by Creative Hoster. Creative Hoster reserves the right to modify the Policy at any time, effective upon posting at http://www.creativehoster.net/terms.php
Prohibited Uses of Creative Hoster Systems and Services:
1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
2. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through Creative Hoster's servers is prohibited. Likewise, the sending of UBE from another service provider advertizing a web site, email address or utilizing any resource hosted on Creative Hoster's servers, is prohibited. Creative Hoster accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
3. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by Creative Hoster customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any Creative Hoster-hosted domain, or referencing any Creative Hoster account, is prohibited.
4. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
5. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org.
6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").
7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any Creative Hoster customers or end-users by any means or device.
9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the Creative Hoster network or on another provider's network.
10. Using Creative Hoster's Services to interfere with the use of the Creative Hoster network by other customers or authorized users.
Customer Responsibility for Customer's Users
Each Creative Hoster customer is responsible for the activities of its users and, by accepting service from Creative Hoster, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an Creative Hoster customer will be forwarded to the Creative Hoster customer's postmaster for action. If violations of the Creative Hoster Acceptable Use Policy occur, Creative Hoster reserves the right to terminate services with or take action to stop the offending customer from violating Creative Hoster's AUP as Creative Hoster deems appropriate, without notice.
Privacy Policy
Creative Hoster will never disclose your information to the public unless you specifically grant us permission to do so.
Your information will never be sold or shared between individuals and companies for any monetry gain or other benefit to Creative Hoster.
